"We know that Sirhan did not shoot the fatal bullets," he told The Daily Telegraph.
"Witnesses said he stood in the wrong place. It was just a distraction."
The lawyer can make these arguments at the hearing of probation in California can be avoided.
Both Sirhan and pepper both insist that the Palestinian Authority had "no recollection" of the murder conspiracy.
Pepper said he was confident before the hearing.
